8th Amendment - Cruel and Unusual Punishment (Death Penalty)

The death penalty is fair

The death penalty is cruel

Side Score: 5

Opening Statement:

How would you feel if your family was murdered, would you forgive the murderer or want him dead? We believe that the death penalty does not violate the 8th amendment, and should be allowed. Our reasons are the safe execution procedure, the criminals that can receive the death penalty, and how executions reduce murder.

1st Argument:

There are three drugs used in lethal injection. The three drugs help the prisoner become unconscious, and make them unable to feel pain, and quickly kill them. The three drugs are very painless for the prisoner and assure a quick death. The prisoners do not feel pain in their death and pass very quickly, this means the death penalty is not cruel.

It is cruel because you are still taking someones life and that person could be anyone. Since you are killing someone might as well shoot them instead since they are still going to die.

It is very different to slowly, painfully torture someone (which the criminal might have done to the victims) than painlessly and quickly killing them in a procedure with a minimal chance of failure. The criminal is spared. The life you are taking is that of a murderer which has murdered and most likely will murder more people if they get freed. Yes, it is possible to kill a murderer in anyway, but to keep the humanity and not make it cruel and unusual, the method of lethal injection is the better way to go and spares the criminal much pain.

First of all, I do not understand your 2nd statement. How does shooting people with guns relate to the death penalty? Also, if you are stating that death penalty basically violates human's right to live, did you think about the actual innocents getting murdered by the criminals? The normal and innocent people deserve more right to live than the murderers. Using safe drugs or any type of punishments for death penalty does not really violate the right to live.

2nd Argument:

The Supreme Court says people who haven’t murdered others shouldn’t be sentenced to death. Prisoners who are sentenced to death have ended a life or more before. They receive what they give. It is an equal punishment to their crime.

In fact, while a lot of murderers did not spare their victim(s) of a painful, agonising death, the death penalty practically guarantees that the murderers death will be painless. Even though murder, one of, if not the most horrible crime, is committed, the penalty will not expose the murderer to any pain at all.

3rd Argument:

For every execution that occurs, it reduces number of people murdered in the following year, by approximately 18. If there are less executions, the following year has ~18 murders more per execution.

Closing statement:

In the end, the criminal does not feel pain from the execution and have committed a serious crime such as murder, furthermore it helps reduce murder! The life of an innocent should be prioritised over the life of a murderer. Imagine if a murderer received a punishment underwhelming of their crimes.

Argument 2: People with mental illness should get less harsh punishments since at times can lose their mind and commit a crime because of their illness, so I think they should get a punishment but not a death sentence because it is not their fault that they have a mental illness.

When somebody has a mental illness, their illness is taken into consideration. If the illness is severe, there are have many times that a criminal's sentence was reduced because they had a mental illness and could not comprehend what they had done. One example of this is the case of Abdul Awkal, whose sentence was reduced from death penalty because he was considered too mentally ill.

Argument 3: There are harsher punishments against different races. In the US white people or black people may have different kinds of punishments against them.

The 8 amendment says that Immoderate bail should not be required, neither should excessive fines be forced, neither should cruel and uncommon punishments be inflicted. Have you ever thought if you cruel punishments such as death sentences be granted? Although some people agree that it should be allowed I think that it should not be allowed because innocent people could be killed, People that have mental illness should not have such a harsh punishment, and people in other races might have different kinds of punishments.

Argument 1:Killing innocent defendants, Sometimes people can frame someone so the other person can get the blame and be killed, also they can get mistaken between people and the wrong person can get killed.

It's very unlikely for the innocents to get killed. Also, the death penalty cases are heavily monitored. It takes a long time, so it's always possible for the innocent to verify that he or she is innocent. If proven innocent, the people can be exonerated. 10% of the death penalty criminals are exonerated; this means that most of the death penalty criminals are guilty, and it's very rare or unlikely for the innocent to get killed, if the innocent fails to prove that he or she is not guilty.

Even if it is rare, there have been some cases where innocent lives have been taken. Also even if it is rare by mistake you are taking someones life that did not do anything.
